Privacy Policy

This Privacy Policy explains how FYCK Limited ("us", "we", or "our") collects, uses, and safeguards information when you use Kerno (the "Service"), including our website at kerno.io, the Kerno web application, and the Kerno CLI. By using the Service, you agree to the collection and use of information in line with this policy.

Terms used here have the same meaning as in our Terms of Service, which together with this Privacy Policy make up your agreement with us.

1. Definitions

  • Service means Kerno, operated by FYCK Limited, including the website, web application, and CLI.
  • Personal Data means data about a living individual who can be identified from that data, or from that data combined with other information in our possession.
  • Usage Data means data collected automatically, either generated by use of the Service or from the Service infrastructure itself.
  • Cookies are small files stored on your device.
  • Data Controller means the person who determines the purposes and manner in which Personal Data is processed. For this policy, we are the Data Controller of your data.
  • Data Processor means any person who processes data on behalf of the Data Controller. We may use service providers to process your data more effectively.
  • Data Subject is any living individual who is the subject of Personal Data.

If you are located outside the United States and provide information to us, please note that we may transfer the data to the United States and process it there.   • request that we restrict the processing of your personal information;
  • be provided with a copy of your Personal Data in a structured, machine-readable, and commonly used format;
  • withdraw consent at any time where we rely on your consent to process your information.

We may ask you to verify your identity before responding to such a request. Please note that we may not be able to provide the Service without some necessary data. You also have the right to complain to a data protection authority about our collection and use of your Personal Data.

9. Your Rights Under CalOPPA

Under the California Online Privacy Protection Act, we agree to the following:

  • you can visit our site anonymously;
  • our Privacy Policy link includes the word "Privacy" and can be found on our website;
  • you will be notified of any privacy policy changes on this page;
  • you can change your personal information by emailing us at hello@kerno.io.

We honor Do Not Track signals. Do Not Track is a preference you can set in your web browser to tell websites that you do not want to be tracked. You can enable or disable it in your browser's settings.

10. Your Rights Under CCPA

If you are a California resident, you can learn what data we collect about you, ask us to delete your data, and ask us not to sell or share it. You can ask us to disclose:

  • the categories of personal information we have collected about you;
  • the categories of sources from which we collect it;
  • the business or commercial purpose for collecting it;
  • the categories of third parties with whom we share it;
  • the specific pieces of personal information we have collected about you.

You can also ask us to delete the personal information we hold about you. In some cases, deletion may be accomplished through de-identification. If you delete your personal information, you may not be able to use certain features that require it.

11. Service Providers

We may employ third-party companies and individuals to help us provide, operate, and analyze the Service. These third parties have access to your Personal Data only to perform tasks on our behalf, and they are obligated not to disclose or use it for any other purpose.

12. Analytics

We may use third-party providers such as Google Analytics to monitor and analyze how the Service is used. Google Analytics is a web analytics service that tracks and reports website traffic, and Google may use the data it collects in line with its own privacy policy. We encourage you to review Google's privacy practices.

13. Payments

For paid plans, we use third-party payment processors. We do not store or collect your payment card details. That information is provided directly to our payment processors, whose use of your information is governed by their own privacy policies. Our processors adhere to the standards set by PCI-DSS, which help ensure the secure handling of payment information. We currently use Stripe, whose privacy policy is available at stripe.com/privacy.

14. Links to Other Sites

The Service may contain links to sites that we do not operate. If you click a third-party link, you will be directed to that third party's site. We have no control over, and assume no responsibility for, the content or privacy practices of any third-party site. We strongly advise you to review the privacy policy of every site you visit.

15. Children's Privacy

The Service is not intended for use by children under the age of 18. We do not knowingly collect personally identifiable information from children under 18. If you become aware that a child has provided us with Personal Data, please contact us, and if we learn that we have collected such data without parental consent, we will take steps to remove it.

16. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. We will notify you of any changes by posting the new policy on this page and updating the effective date above. Where appropriate, we will also let you know by email or a prominent notice on the Service before the change takes effect. You are advised to review this policy periodically.
